Judge Dismisses Lawsuit Challenging $2.6 Billion Deal

Original Complaint Filed by Consumer Plaintiffs

A federal judge has dismissed a lawsuit that sought to block Alaska Airlines' plan to acquire Hawaiian Airlines for $2.6 billion. The lawsuit, filed by consumer plaintiffs, alleged that the deal would result in higher fares and reduced competition in the airline industry.

In a ruling issued on Monday, Judge Leslie Kobayashi of the U.S. District Court for the District of Hawaii dismissed the lawsuit, finding that the plaintiffs had failed to demonstrate a likelihood of success on the merits of their claims.

Alaska Airlines and Hawaiian Airlines have welcomed the judge's decision. In a statement, Alaska Airlines said that the acquisition will allow it to “create a stronger, more competitive airline that will benefit consumers.” Hawaiian Airlines said that it is “pleased with the court's decision and looks forward to completing the merger with Alaska Airlines.”

The proposed acquisition is still subject to regulatory approval. The U.S. Department of Justice is currently reviewing the deal, and a decision is expected later this year.
